TERMS & CONDITIONS
These Terms govern the sale of goods/services by Mumdays and will form the basis of a contract (“Contract”) between Mumdays and you. If you are unsure about any part of these Terms, please ask us for clarification.
A legally binding contract between us and you will be created upon Our acceptance of your Order, indicated by our order confirmation. Order confirmations will be provided in writing via email confirmation on receipt of payment.
We shall ensure that the following information is given or made available to you prior to the formation of the Contract between us and you, save for where such information is already apparent from the context of the transaction:
The main characteristics of the goods/services/experiences.
· Our identity and contact details (as set out above)
· The total price for the goods/services/experiences including taxes or, if the nature of the Goods/services/experiences is such that the price cannot be calculated in advance, the manner in which it will be calculated;
· Where applicable, all additional delivery charges or, where such charges cannot be calculated in advance, the manner in which they will be calculated;
· Where applicable, the arrangements for payment, delivery and the time by which we undertake to deliver the goods/services/experiences
To book your experience you must first register online at www.mumdays.co.uk/register You will need your unique ID to redeem your experiences. Once registered, you are able to check experience details and book your experience directly with our experience suppliers. If you already have an account with Mumdays you will need to input your unique ID in the relevant section once you are within your account. You will then receive a booking confirmation (“Booking Confirmation”) from that partner directly, including any steps you must follow to get the most from your experience. Once your booking date is confirmed, you may be required to bring the confirmation email with you on the day.
Do you need to set out where the ID comes from?
Price and Payment
The price of the goods will be that shown on our website in force at the time of your order. If the price shown in your order differs from our current price we will inform you upon receipt of your order.
If we quote a special price which is different to the price shown on our current website, the special price will be valid for the amount of time specified on that promotion or, if the special Price is part of an advertised special offer, for the period shown in the advertisement. Orders placed during this period will be accepted at the special price even if we do not accept the order until after the period has expired.
Our prices may change at any time but these changes will not affect any orders that we have already accepted.
We have made every reasonable effort to ensure that our prices, as shown on our current website are correct. Prices will be checked when we process your order. If the actual price of the goods is lower than that stated in your order, you will be charged the lower price. If the actual price of the goods is higher than that stated in your order, we will ask you how you wish to proceed.
All prices include VAT. If the rate of VAT changes between the date of your order and the date of your payment, we will adjust the rate of VAT that you must pay.
Our price will clearly state whether delivery is included or not. Where delivery is excluded it will be added to the final sum due.
All payments for Goods must be made in advance before we can despatch the Goods to you.
We accept the following methods of payment: VISA, VISA DEBIT, VISA ELECTRON, VISA DELTA, MASTERCARD, MAESTRO DEBIT CARDS, PAY PAL, and any other methods which may be clearly advertised on the site from time to time.
Mumdays experience vouchers “Vouchers “do not have a value stated on them and entitle the holder to the experience(s) and/or service(s) stated in your Mumdays experience gift pack. Fulfilment of the experience will be carried out by our carefully selected mum-approved third party experience operators acting on our behalf.
All Mumdays Vouchers carry a unique ID which must be quoted when liaising with Mumdays regarding your experience(s)/service. Vouchers must be kept safely and securely and you should not share your unique ID with anyone. Upon receipt of your Mumdays Voucher you will need to register for a Mumdays account and input your unique ID during the sign up process. If you already have an account with Mumdays you can add additional unique IDs to your account which will enable you to see more information about the experience(s) and/or service(s) you have received. You will be able to book your experience(s) and/or service(s) from the links and instructions available to you within your account. We advise you to take good care of your Mumdays Voucher. We cannot accept responsibility for any loss you may incur as a result of theft, impersonation or identity fraud.
Mumdays reserves the right to decline to process an order for any reason whatsoever.
The contract is between you and Mumdays once your order has been processed and we have received payment.
· You may change your order at any time before we despatch the goods by contacting us.
· Any request for change must be made in writing to firstname.lastname@example.org
· If your order is changed we will inform you of any change to the price in writing.
· You may cancel your order at any time before we despatch the goods by contacting us. If you have already paid for the goods the payment will be refunded to you within 30 days. If you request that your order be cancelled, you must confirm this cancellation in writing.
· We may cancel your order at any time before we despatch the goods in the following circumstances:
· The goods are no longer in stock and we are unable to re-stock (if, for example, the goods are discontinued); or
· An event outside of our control continues for more than 14 working days
· If we cancel your order under and you have already paid for the goods or experiences, payment will be refunded to you within 30 working days. If we cancel your order, the cancellation will be confirmed by us in writing.
For the protection of our customers and to ensure that your credit, debit or charge card is not being used without your consent, PayPal will validate name, address and other personal information supplied by you during the order process against appropriate third party databases.
By accepting these terms and conditions you consent to such checks being made by PayPal. All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998.
If an order cannot be fulfilled for any reason, Mumdays will refund all monies promptly. Duplicate orders are sometimes inadvertently placed or despatched.
We ask that you return any duplicates immediately or contact us for further instructions. Should both vouchers be used, we will be entitled to claim payment for the costs incurred.
All prices shown on the Mumdays website are in GBP and all transactions are conducted in GBP. If ordering from overseas or from a foreign currency account, you may be charged fees by your bank to process the transaction. These fees are in addition to any prices on our website and are beyond our control.
Please note that descriptions of experiences, timings and formalities given in the product and experience descriptions on the Mumdays website or in any other Mumdays literature are only intended to present a general idea of the experience, and shall not be considered binding.
Experiences are for one participant only unless otherwise stated.
We reserve the right to make changes to the description of goods, services and experiences that may be required to conform to any applicable safety or other legal or regulatory requirements without notice.
Photographs are for illustrative purposes only and do not form part of any contract between you and Mumdays. As Mumdays offers experiences with a selection of partners, details such as session lengths, itineraries, equipment used and numbers of participants may vary.
We cannot be held liable for any delays, breakdowns or limitations which may occur that are beyond our control. We reserve the right to alter any part of the experience where such an alteration has been imposed by the operator.
We cannot be held responsible for descriptions by or on any third party or agent sites. Experiences may occasionally be withdrawn for reasons outside of our control, and Mumdays cannot be held liable for any costs incurred as a result.
Should an experience be withdrawn either you or your recipient will be advised and offered the opportunity to exchange your voucher for one with the same face value. If alternatives are available, no refunds can be offered.
All services and experiences sold on mumdays.co.uk are offered subject to availability.
Please note that the selection detailed at the time of purchase may change from time to time. Mumdays reserves the right to change its experience and service providers during the validity of the Voucher.
The recipient is free to book their preferred date within the Voucher validity period. Please note that all experiences are subject to availability and, in some cases, may be subject to weather conditions. We recommend customers book well in advance to ensure your preferred time/date is available.
We recommend booking as early as possible as you must have undertaken your experience before the expiry date of your Voucher. You will be able to see the expiry date for your experience(s) and/or service(s) once you register an account on Mumdays using the unique ID on your voucher. We recommend that you do not make any travel, accommodation or other arrangements until you have received confirmation of your booking from the experience operator. Once a date has been booked and confirmed with a supplier your Voucher will be deemed to be used at that point.
Most experiences are subject to restrictions.
These could include (but are not limited to) age, height, weight, physical and medical restrictions, and may vary from centre to centre so please check before making your booking. It is your responsibility to ensure that you choose an experience appropriate for the intended recipient and it is the responsibility of the recipient to double check with our partners that they are a viable candidate for their experience(s). If you are unsure of suitability please email us on email@example.com us and we will be happy to help and advise.
We endeavour to make Mumdays experiences suitable for participation by disabled people and we recognise that certain experiences may present difficulties for those facing disabilities. Some of our partners are able to welcome disabled persons in their facilities. We do however recommend that you ask us about any relevant disability at the time of ordering to enable us to do our best to meet the disabled participant’s needs.
If you require specific information about suitability of specific experiences, venues or services for a disabled person we are able to provide this upon request.
Prices & locations
We reserve the right to vary the prices of the experiences and services which we offer. Locations are correct at the time of going to press but may change or be withdrawn for reasons beyond our control.
Please note that delivery is currently only possible within the United Kingdom.
When we provide you with confirmation (“Order Confirmation”), we will provide an estimated delivery date. Please note that estimated delivery dates may vary according to the availability of goods, your location, and circumstances beyond our control. Unless agreed otherwise, the goods will be delivered without undue delay and in any case no later than 30 calendar days after the date on which the Contract is formed.
Delivery will be deemed to have taken place when the goods have been delivered to the delivery address indicated in your order.
You own the goods once we have received payment in full for them.
· If we refuse to deliver the goods, you may treat the Contract as being at an end and we will reimburse you without undue delay.
Unfortunately, Mumdays Vouchers cannot be replaced if they are lost, damaged or stolen and are invalid if altered or tampered with. Mumdays accepts no liability in these circumstances.
Mumdays Voucher validity period is generally 18 months from date of purchase unless otherwise stated. Experiences must be booked and undertaken prior to the expiry date which you will be able to see once you have registered your account using your voucher’s unique ID. Otherwise the Voucher will be deemed to be invalid and Mumdays will not accept any liability.
In the event that your Mumdays Voucher experience(s) is not suitable then please contact us on firstname.lastname@example.org and we will offer alternative experiences or services for the same value.
However, if your exchange is more expensive than your original voucher you will be required to pay the difference.
If your exchange is less expensive than your original voucher the difference will be held as a credit to use against any future purchase up until the original expiry date of your voucher and is non-refundable.
The exchanged voucher will carry the same expiry date as the original purchased voucher.
Refunds can be made on unused Vouchers bought direct from Mumdays within 14 days of purchase.
A refund cannot be given once the booking has been made with the experience provider.
Refunds are always made to the person who purchased the Voucher and if originally purchased by credit or debit card the refund will be credited to the same card. If the card has expired you will need to request a refund in writing, quoting details of the new card.
Refunds cannot be given on expired or exchanged vouchers.
Competition prizes or promotional free gifts cannot be refunded.
To exercise your right of refund you must give written notice to us by email, giving details of your order and where appropriate it’s delivery.
Notification by telephone is not sufficient. If you would like to request a refund please contact us on email@example.com and send your voucher in the post, along with a covering letter explaining the reason for your request to Mumdays LTD, 20-22 Wenlock Road, London, N1 7GU.
Once you have notified us we will refund the purchaser for the price of the voucher (excluding delivery charges and credit or debit card fees).
We are not able to cover any costs related to the cost of returning your Voucher for exchange or refund. We strongly recommend that a secure delivery service such as Royal Mail guaranteed signature required delivery (with postal insurance as appropriate) is used as Vouchers cannot be exchanged or refunded until they are received by us.
You are solely responsible for the cost of returning goods to us and we strongly recommend that you send returned goods to us via guaranteed signature required delivery.
If you are not satisfied with any goods purchased from us you have the right to return them in exchange for a refund, please note that it is not possible to exchange or refund a voucher once an experience has been booked.
If you wish to return a Voucher or other goods to us you must do so within 14 days of taking delivery, telling us why you wish to return the goods.
All goods must be returned to us in their original condition, in their original, un-opened packaging, accompanied by proof of purchase.
Experience and service providers
Mumdays has contractual agreements with its service and experience providers regarding their standard of performance and, where appropriate, service and experience providers are registered with their relevant controlling or regulatory bodies.
Once a booking has been made with a Mumdays partner or experience provider the participant is also bound by the terms and conditions of that provider. By purchasing or redeeming a Mumdays Voucher you acknowledge that experiences are dependent on certain factors beyond the control of Mumdays and that Mumdays is not liable for the cancellation, postponement or alteration of any experience for reasons beyond its reasonable control (including but not limited to weather-related reasons, mechanical failure, location changes or otherwise).
Please note that experiences and other products are subject to change without notice. This does not affect your statutory rights.
Problems with your experiences
At Mumdays we welcome all feedback on your experiences and services. Should there be a problem on the day of your experience we strongly advise you to discuss it with the host or the experience provider at the time of your experience so that they have an opportunity to put matters right.
If you have attempted resolution but the problem was not resolved on the day, please write to us within a week of your experience (providing your Voucher unique ID, participant’s name and venue details, including who you spoke to on the day) and we will be happy to take the matter up with the service provider on your behalf.
The address to write to is; Customer Services, Mumdays LTD, 20- 22 WenLock Road, London, N1 7GU. The service provider will have the opportunity to investigate and respond.
Cancellation by experience operators
If an experience is cancelled by the provider either before or on the day of the event due to circumstances beyond their control, the service or experience provider will arrange to re-book the participant at a mutually agreed time on our behalf.
In the event that the service provider is unable or no longer able to provide the product or service specified an alternative (equivalent or better) will be suggested to the customer. If no suitable alternative can be agreed upon, equivalent value credit will be issued to the original purchaser of the Mumdays Voucher.
Please note that Mumdays is not able to be held liable for any costs including (but not limited to) travel expenses or pre-booked accommodation costs incurred by the participant in the event of a cancellation and Mumday’s total liability for any claim in connection with one of our experiences shall be limited to the price paid for the experience.
Cancellation by participants
Once you make a booking with an experience provider you are bound by their terms and conditions. Make sure you understand their rules regarding changing or cancelling a booking (particularly at short notice) as a refund will not be offered in the case of infringement of these rules.
Many of our experience providers have a 24-hour cancellation policy. This information is available via the partner specific terms and conditions links on each partner page.
Mumdays Cancellation Indemnity policy may provide a replacement Voucher in the event of cancellation by the participant owing to circumstances beyond their control.
Mumdays has no responsibility for any services provided or not provided by any other party listed on our site. We accept no liability for any act, omission or default, whether negligent or otherwise, of any third party service provider and have no liability for any loss or damage incurred by any negligent act or omission of any third party service provider or any other third party.
If Mumdays ceases to operate suppliers will not be liable to fulfil any unbooked experiences for which they have not been paid for by us. Purchasers will instead be able to seek a refund from the payment provider.
Where liability cannot be excluded, such liability is limited to the value of your order. We make no warranty or representation regarding the standard of any third party services to be provided to you.
All Mumdays Vouchers are issued subject to the terms of each third party business and their terms. We do not have any power or control over third party service providers and their operations. We take all reasonable precautions to ensure that the suppliers we promote are safe and reliable. However, we make no guarantees or warranties about the services which are provided to you by the third parties shown on mumdays.co.uk.
Notwithstanding that we will take all reasonable precautions to ensure that third party service providers are licensed and compliant, where a third party service provider is not properly licensed or compliant with any applicable law, bylaw or regulation, we accept no liability for any loss or damage suffered by you or any third party as a result of such non-compliance.
Nothing in these Terms will limit our liability for death or personal injury caused by negligence or wilful act or omission of Mumdays or its employees. Except as specifically set out in these terms, to the extent permissible by law, we disclaim and excludes all other warranties, whether express or implied, by statute or otherwise.
These Terms do not affect your statutory rights as a consumer.
Venues and locations
Every Mumdays’ supplier is carefully chosen. We are always adding to the experiences and locations we offer, but occasionally we may need to withdraw venues or suppliers featured here for reasons beyond our control.
If your preferred location or supplier is withdrawn or if your service provider is not available in a convenient location, you will be offered alternative venues or suppliers wherever possible, but please note this is likely to be at a different location or with a different supplier.
Where locations are stated as ‘UK wide’, locations may be limited in some areas.
Each venue and experience provider has its own terms (available upon request) and your participation is conditional on your acceptance of these.
Competition prizes, special offers and promotional offers
Please note that any Mumdays competition prizes, special offers, special prices, and promotional offers cannot be refunded or extended unless otherwise specified. (A promotional product refers to a Voucher which was sold at a discounted price or as part of a special offer, whether or not this is stated on the Voucher).
Events outside of our control, force majeure
We will not be liable for any failure or delay in performing our obligations where that failure or delay results from any cause that is beyond our reasonable control. Such causes include, but are not limited to: power failure, internet service provider failure, strikes, lock-outs or other industrial action by third parties, riots and other civil unrest, fire, explosion, flood, storms, earthquakes, subsidence, acts of terrorism (threatened or actual), acts of war (declared, undeclared, threatened, actual or preparations for war), epidemic or other natural disaster, or any other event that is beyond our reasonable control.
If any event described under this clause that is likely to adversely affect our performance of any of our obligations under these Terms then:
we will inform you as soon as is reasonably possible;
our obligations under these Terms will be suspended and any time limits that We are bound by will be extended accordingly;
we will inform you when the event outside of our control is over and provide details of any new dates, times or availability of goods as necessary;
If the event outside of our control continues for more than 14 days, we will cancel the Contract and inform you of the cancellation. Any refunds due to you as a result of that cancellation will be paid to you as soon as is reasonably possible;
If an event outside of our control occurs and you wish to cancel the Contract, you may do so in accordance with your right to cancel as laid out in these terms.
How We Use Your Personal Information (Data Protection)
All personal information that we may collect (including, but not limited to, your name and address) will be collected, used and held in accordance with the provisions of the Data Protection Act 1998 (DPA 1998) and your rights under that Act.
We may use your personal information to:
· provide our goods and services to you;
· process your payment for the goods; and
· Inform you of new products and services available from us. You may request that we stop sending you this information at any time.
· we will not pass on your personal information to any other third parties without first obtaining your express permission.
Other Important Terms
We may transfer (assign) our obligations and rights under these Terms (and under the Contract, as applicable) to a third party, this may happen, for example, if we sell Our business). If this occurs your rights under these Terms will not be affected and our obligations under these Terms will be transferred to the third party who will remain bound by them.
The Contract is between you and us. It is not intended to benefit any other person or third party in any way and no such person or party will be entitled to enforce any provision of these Terms.
If any of the provisions of these Terms are found to be unlawful, invalid or otherwise unenforceable by any court or other authority, that / those provision(s) shall be deemed severed from the remainder of these Terms. The remainder of these Terms shall be valid and enforceable.
No failure or delay by us in exercising any of our rights under these Terms means that We have waived that right, and no waiver by us of a breach of any provision of these Terms means that We will waive any subsequent breach of the same or any other provision.
Governing Law and Jurisdiction
These Terms, the Contract, and the relationship between you and us (whether contractual or otherwise) shall be governed by, and construed in accordance with English law.
Any dispute, controversy, proceedings or claim between you and us relating to these Terms, the Contract, or the relationship between you and us (whether contractual or otherwise) shall be subject to the jurisdiction of the courts of England, Wales, Scotland, or Northern Ireland, as determined by your residency.
